What are ARCO rights?

The applicable legislation regarding personal data protection, Organic Law 15/1999, of 13 December on Personal Data Protection (LOPD) and Royal Decree 1720/2007, of 21 December, which approves the regulation stated in it (RDLOPD), awards the titleholders of said data the rights to access, rectify, cancel and oppose (the ARCO rights) them.

  • Access: Right to know what personal data are contained in a file.
  • Rectification: Right to rectify incorrect or incomplete data in a file.
  • Cancellation: Right to cancel and block incorrect data in a file.
  • Opposition: Right to oppose certain, specific processing of personal data within a file.

These rights have the following characteristics:

  1. There are personal rights. They may only be exercised by the affected party, the legal representative of the affected party and the voluntary representative of the affected party.
  2. They are independent rights. It should not be considered that exercising one of these rights is a prior requisite to exercise another.
  3. There are free rights. Exercising this right may not incur an additional income for the file manager.

How can I exercise my ARCO rights?

ARCO rights may be exercised by filling in the forms that are available in the Documents to be filled in to exercise the ARCO rights. section. Once you have filled in the form for the right you wish to exercise, said form may be submitted using one of the channels detailed in the How do I process the documentation? section.

How do I process the documentation?

Once you have filled in the documents within the Documents to be filled in to exercise the ARCO rights section, you can submit them by using one of the following channels:

  • In person. In any of the Public Administration Registry Offices in the Principality of Asturias.
  • By post. By sending a letter by ordinary post to the OFICINA DE ATENCIÓN CIUDADANA (SAC) – Edificio de Servicios Múltiples C/ Coronel Aranda, 2, 33005 – Oviedo (Asturias).
  • By post. By sending an e-mail to sac@asturias.es

To receive further information about the procedure you need to follow to request any of the bodies of the Public Administration of the Principality of Asturias to exercise your ARCO rights, you can call the CITIZENS’ ADVICE CENTRE (SAC) although the application must always be done in writing using one of the aforementioned channels.

ARCO rights may be exercised by filling in the form for the right that you wish to exercise and submitting this document in in person, by ordinary post or by e-mail, as explained in How do I process the documentation? section.

The right to access must be exercised when you wish to find out which personal data is held in a file.
