Inclusion of Information in BOPA

How to insert a text into BOPA?

  1. It is required:

    A standardized application form to insert texts.

    The application form must include:

    1. Name and surname or business name, address and Spanish National Identity Card or Tax Identification Number of the applicant entity (Regional Ministry, Territorial Government, City Council, Court, etc.)
    2. Name, surname and signature of the person or authority that orders the insertion of the text into BOPA (Regional Minister, Territorial Director, Mayor, Magistrate, Judge, etc.)
    3. Date of the application.  
    4. Heading of the provision to be published (Act, decree, resolution, notification, public information, call, etc). It must be pointed out specifically that it is aimed at being published into the OFFICIAL GAZETTE of the Principality of Asturias.
  2. Texts to be published:

    Texts to be published shall be single folios with four main sections that shall be clearly distinguished: 

    1. Entity that dictates the provision (Regional Ministry, City Council, Court, Provincial Directorate, etc).  
    2. Heading of the provision (Act, Decree, Resolution, Notification, Public Information, Call, Subpoena, Deferral Order, etc). Those headings of provisions issued by the Government of the Principality of Asturias as well as the general provisions, which are also published into BOE, will be added to the BOPA’s Summary.
    3. Text of the provision (it is only required the text that is going to be published).
    4. Place, date and signature of the relevant authority that dictates the provision.
  3. How to submit texts:

    Applicants may submit original texts (copies and faxes are not allowed). Texts are required to be printed over white paper so if they contain any compulsory letterheads and logos, as well as stamps or signatures, they will not hide the corpus of the text to be published.

    • Capital letters are not allowed in the headings or consecutive text.
    • Bold type and underlining will be avoided.
  4. Where and how to send texts:

    All applications shall be sent in paper to the addresses stated on the upper right side of your screen (Section: Submission of applications).

    If you want to speed up the publication, applications and texts can also be sent by email or in a digital support (CD format).

  5. Payment of fees for inserting information into BOPA

    (Regulated by the Act of the Principality of Asturias 18/1999, of 31 December, on Budget and Tax Administrative Measures, BOPA no. 301 of 31 December 1999)

    All announce or provision published into the OFFICIAL GAZETTE of the Principality of Asturias requires the payment of fees as insertion rights, except those circumstances where the texts are tax-free according to the legislation currently in force.

    Exemptions to the payment of fees:    

    1. Acts and other general provisions issued by the Spanish Government and the Government of the Principality of Asturias.
    2. Those compulsory texts issued by the Government of the Principality of Asturias that need to be published, except those texts whose legal procedures have been developed at the instance of private individuals or if they are referred to procedures of administrative hiring.
    3. Provisions and texts of general interest issued by official bodies or authorities. For the purposes of this announcement, all texts issued by local administrative entities of Asturias will be classified as general interest texts if they are referred to the approval and amendments of budgets, agreements on imposition of penalties, changes of regulatory bylaws, organic and services regulations, and calls for the provision of vacancies within the annual job offers.
    4. Notifications issued by the Ordinary Jurisdiction where it is in litigation with legal aid or criminal prosecution, apart from those circumstances where any of the parties to a suit have paid the costs.
    5. Resolutions issued by the Court of Justice whose publication is free according to the law.
    6. Any other tax-free publication according to any legal precept issued by the Government of the Principality of Asturias.

    As for 4 and 5 epigraphs, applicants need to prove the publication is tax-free so the legal precept shall be enclosed. If it is not submitted, they will not be classified as tax-free publications.

    TAXABLE PERSON  

    The taxable person is the legal or natural person that applies for the insertion of the text into BOPA. However, as for publications related to legal procedures start at the instance of private individuals (e.g. applications of licences, court resolutions, etc.), and procedures of administrative hiring, the payment could be transferred to the legal or natural person who is the beneficiary of the procedure. The applicant body is in charge of informing to the beneficiary on this special circumstance.    

    PAYMENT OF FEES ON BEHALF OF THE BENEFICIARY OF THE PROCEDURE   

    As for announcements that must be paid by the beneficiary of the procedure, the applicant body is in charge of notifying to the OFFICIAL GAZETTE of the Principality of Asturias on the identity of the taxable person (name, surnames, business address, full address, and Spanish National Identity Card or Tax Identification Number). If this requirement is not fulfilled, the transfer of payment will be not made.  

    INSERTION FEES CURRENTLY IN FORCE  

    • Ordinary Procedure (font-family: verdana; font-size: 9): 0.063367 EUR. 380.161 EUR per page with an effective area of 245 mm height and 175 mm width, and 6,000 characters. Blank spaces will be considered normal characters so they will be priced accordingly.
    • Tables, charts, maps, files, and other non-text elements: 1.551 EUR per millimetre of height for a column of 175 mm width, regardless of the percentage of the total line width of 1 mm.
    • Urgent Procedure: a 100 percent increase over the current fees.

Submission of applications

Texts can be submitted in CD format, but they will be also sent or submitted in paper.
